Okay, I'm not talking about November 22nd, I'm not talking about six months before that, I'm not talking about if she's in danger today. The question is, was on November 24th, was she in immediate danger? That's the only thing that I'm dealing with here today.

KM - 04:36 That night, Corbin, he didn't comply with the order when we were served, so I had to have sheriff assistance to get my daughter. Whenever I did get her, Corbin himself sent her with a phone that belonged to him. He had recently switched phones, but I went through the phone and it was still logged into all of his current accounts including Facebook, Google, and some other stuff. So I have some Photos of messages from that phone showing that he is in fact or was at that time using drugs.

KM - 05:27 I also have a photo of some messages between him and his mother. Where she is asking him to have my daughter urinate in a cup for her husband to pass a drug test and Corbin agrees to do that. I also have photos of messages from his own brother-in-law saying that he is using and he has used with him in less than the last year.

EG - 10:38 After getting the writ of assistance because he wouldn't give the child to the mother, the sheriff contacted Mr. Parise and They were bringing her to the car and he walked her out to the car and sat her in the back seat and then said just a second and ran inside and came back out with a phone and instructed Karlee that she could use the phone to call him anytime she wanted to and told Kyla that she needed to connect the phone to the Wi-Fi so that he could talk to his daughter when he wanted to.
Simmons - 11:29 And that. So he took, got the phone from his house, brought it to Karlee and told her she could use that phone to call him at any time.

I also have a post from Facebook where he was saying to the low life human being who had access to my personal information in regards to me is who he's talking about and having access to this stuff.

So when it comes to this message in particular, I was referring to the months and months that I was confiding in her thinking that we had an excellent co-parenting arrangement and we did. It was out of the ordinary. And I confided in her when I was I was in a relationship tiff, nothing but. And she honestly, this kind of shows that she took it out of context.

CP - 19:12 Okay, good afternoon your honor. Like you have said, this is a hearing for immediate danger and anything following. As per the 24th, I had absolutely no danger and I've never, my daughter comes first and foremost, my utmost, she's my priority. Over everything I do, I base around my daughter, that's it. It's kind of easy to oversee that, you know, especially when there's 49 pages of allegations of text messages that have literally been chopped up and typed out personally with not even screenshotted. I mean, anyway, that's.
CP - 19:57 So the weird thing to me is we've always shown each other the utmost respect. With the occasional disagreement here and there, which should be expected, but there has been no concern for Karlee's safety and nothing has changed at all when it comes to custody of our daughter. Recently, because I'm having to relive it over and over, there are two things that come to mind that may be factors to me. One of them is It is now my wife. She is a huge part of Karlee's daily life and Karlee adores her. That's Courtney.

In fact, at one point, I can recall, she even asked Courtney if she could call her mom, she asked her. Karlee's mental state, I take very seriously, as well as Courtney does, too. And that's kind of what defines and transforms her into the young lady she will once be.
CP - 21:13 I never influenced her until I saw it. I love her and her mind just the way she is. And the other thing I could think of is the second point maybe for all this coming about out of thin air and that's changed was I applied for TANF for just a few brief months ago. Now, I know it sounds kind of silly to think that somebody would do all this over TANF. Money is obviously on the forefront of Kyla's mind, I know this to be true, and because in addition she filed on this very motion today, which we're all here for today, and I'm sorry we're wasting your time for it, but she filed over the fee deferal for a waiver, which tells me Which I'm noting true because in addition she filed on this very motion day for fee deferal for all which tells me if I'm wrong it appears.
CP - 22:26 That she deceived the clerk and the courts on her financial stance which she was granted a fee deferral waiver for her filing as the clerk generally makes these decisions based on what they're taught or told at the very moment by the filer on paper. And for a fee deferral waiver they make a decision by your place of employment, your living arrangements, and I believe assets when I called in and asked them. Well she makes, Kiela Manes makes about $45 an hour.
KM - 22:50 Does that have anything to do with what we're here for?
Simmons - 22:54 So Mr. Parise, I don't actually see how it does first of all. And second of all, if you want to complain about something like that, I suppose you could complain to the presiding judge, but I don't make fee deferral waiver decisions. And so you need to move on.
CP - 23:10 All right. So seeing how Today directly relates to Miss Manes alienating my daughter from me. She has done so by not only getting a restraining order, which is out there.

CP - 23:59 So this restraining order that's been placed against me has strictly made it so I can't contact my daughter at all. Prior to this, her leaving the 24th, she gave me a lot of 10 minutes and I could talk to her. I've raised her for the past five years, with no complaints from anybody, especially Ms. Mains, who has been barely, barely been around. So that being said, now she's got a restraining order. I'm alienating my daughter from me. I haven't spoken to her in two weeks.
CP - 24:23 It's the longest I've ever spoken to her. She changed school the very next day after getting this immediate danger. She's been there for two years and changed her on a temporary custody order, which was pretty dramatic. I'm sure for Carly, I know her more than anybody. In my opinion, your honor, everything that's came to light after this just shows me that Kiela is the one actually putting our daughter in immediate danger, if anybody. I've never done wrong by my daughter ever.
CP - 24:54 Like I said, my whole world revolves around her. And you know there's not a bit of evidence supporting claims of immediate danger. I can back up that statement right here right now. That's what I was kind of just kind of trailing off on was I literally have probably up more like 30 plus times I catch her in lies where she leaves messages out and for her very own evidence she uses text messages. I have screenshots. She leaves them out.

Simmons - 25:23 Okay, so here's what you can submit to me. You can submit to me things that you think prove that your daughter wasn't in an immediate danger. It has nothing to do with whether or not you believe that at some point in time she has sent you text messages with stuff left out or at a later time presented it. I am dealing with kind of a one... CP - 28:45 So, alongside everything that's been said, false accusations, all that stuff, I just wanted to reiterate on the fact that Kiela's been barely around for Karlee's entire life. I mean, I ended up getting sole custody to her five years ago from your very own judgment, but Kiela has very little interest in Karlee, that's what really just kind of puzzles me. At times, a lot of times, I thought this was the right thing to do, I would encourage Not only Karlee goes to your mom, I would encourage Kiela as well by making calls, texts, you know, trying to get her come to the visited.

She never spoke to me about any of this. Literally caught me out of the blue off guard the 24th. I was at work driving truck for UPS and that's when I got a call.
CP - 29:59 It's the first time I ever heard about a thing. Now I have video of her giving me the paperwork. When I showed up, serving me, not even giving me five minutes to read it, getting out of her car, and basically yelling for me to comply. That's about as much heads up as I've ever received.

CP - 30:36 You'll get his testimony later, but yeah, nobody at all said anything about any sort of dangerous anything. I had four sheriffs in my house that night. I invited them in. You know what I mean? Like I said, it was all caught off guard. I was working.

CP - 22:26 That she deceived the clerk and the courts on her financial stance which she was granted a fee deferral waiver for her filing as the clerk generally makes these decisions based on what they're taught or told at the very moment by the filer on paper. And for a fee deferral waiver they make a decision by your place of employment, your living arrangements, and I believe assets when I called in and asked them. Well she makes, Kiela Manes makes about $45 an hour.
